Benue governorship tussle: Alia triumphs at the Supreme Court

The Supreme Court on Monday, January 8, 2024, upheld the election victory of Governor Hyacinth Alia of Benue State just as it dismissed the appeal earlier filed against him by the Governorship candidate of the Peoples Democratic Party (PDP), in the March 18, 2023 polls.Before the decision of the apex Court, Counsel to Hon. Titus Uba, the Governorship candidate of the PDP, Mr. Sebastian Hon file an application for the withdrawal of the appeal.

Hon. Uba, who was Speaker of the Benue State House of Assembly, had challenged the victory of Governor Alia of the All Progressives Congress (APC).

Alia however recorded victory at both the Election Petitions Tribunal and the Court of Appeal which affirmed his victory in the Benue State Governorship election as declared by the Independent National Electoral Commission (INEC).

The tribunal had declined jurisdiction to hear the petition saying that it was a pre-election matter.

 

Similarly, the Court of Appeal held that Uba should have prosecuted the forgery allegation against Sam Ode, the deputy governor to Governor Alia at the High Court and not the tribunal since it was a pre-election matter, stressing that the PDP candidate, Hon Uba also failed to prove allegations of forgery against Ode beyond reasonable doubt.
