Court Shields Dangote Refinery from Supply Disruption Amid PENGASSAN Dispute

The National Industrial Court in Abuja has issued an interim order safeguarding operations at the Dangote Petroleum Refinery and Petrochemicals FZE from potential disruption linked to a dispute with the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN).

In a ruling delivered on Monday, Justice Emmanuel Sublim restrained PENGASSAN from carrying out its planned strike action against the refinery. The court also barred key regulatory agencies—including the Nigerian National Petroleum Company Ltd (NNPCL), the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA), and the Nigerian Upstream Petroleum Regulatory Commission (NUPRC)—from cutting crude oil and gas supplies to the facility.

 

The decision followed an ex parte application filed by the refinery’s counsel, George Ibrahim (SAN), who argued that any interruption of crude and gas supply would cause irreparable damage to the multi-billion-dollar plant.

 

Granting the application, Justice Sublim emphasized that the restraining order was necessary to preserve the refinery’s operations while the substantive issues in dispute are being determined.

 

The court directed that the order and related court processes be served immediately on all defendants and adjourned the case until October 13 for hearing of the motion on notice.
